Terms and conditions

The user expressly accepts these General Terms and Conditions of Contract, which will govern the contractual relations established between the User and the entity Golf Camp de Mar SL, with CIF B57878274 and address in Camp de Mar (Mallorca), C/Cromlec, with regard to the green fee sales service through the website www.golfdeandratx.com.

These General Conditions have been established in accordance with the provisions of Law 7/1998 on General Contracting Conditions, Law 26/84 on the Defence of Consumers and Users, Organic Law 15/1999 on the Protection of Personal Data, Law 7/96 on the Regulation of Retail Trade, Law 34/2002 on Information Society Services and Electronic Commerce and other applicable legal provisions on the subject.

1.- Conditions of Service:

By accepting these General Conditions, the User/Client expressly accepts full and unreserved adherence to them, as well as to the Particular Conditions that regulate the use of the contracted services, declaring to have legal capacity to contract the services offered through the website. This document may be printed and stored by users, who may also request any clarification of its contents by calling 0034-971236280 or by sending an e-mail to info [at] golfdeandratx.com.

Golf Camp de Mar SL may at any time and without prior notice modify these General Conditions, by publishing these modifications on its website so that they can be known by the Users. With the publication of the modifications made on the web page it will be understood that the duty to notify the Users of these modifications has been fulfilled.

To access the contracting of the services offered on the website, the User must first fill in all the data requested on the form established for this purpose and click on the acceptance button.

2.- Contracting procedure:

2.1 Contracting: The parties expressly declare that the acceptance of the offer of Golf Camp de Mar SL selected by the User/Client, will occur with the completion by him/her of all the steps of the contracting procedure detailed on the website, which implies full and express acceptance of these conditions.

The contract will be completed when the bank associated with the credit card provided by the Customer authorises the transaction. At this moment, a confirmation page of the reservation will appear which can be printed as proof of the reservation.

By accepting the contract, the customer expressly accepts both the general rules of play required by the Royal Spanish Golf Federation and the specific rules determined by the golf course where the customer purchases the green fee.

The conditions and rates of the services offered are those appearing on the website at the time of contracting them. Golf Camp de Mar SL may freely modify the rates without prior notice by publishing them on the website. These rates will include VAT or the tax which, where applicable, replaces it, at the rate established in each case by current legislation.

2.2. Golf services: The user/client must respect the rules of operation and organisation established by the golf course. Acceptance of the offer by the user implies express acceptance of these rules.

When contracting golf services, special attention must be paid to the federation regulations governing this sport, and in particular to the following issues:

For the practice of golf on the course, a civil liability insurance is required in case of accidents during the practice of this sport. The reservation of green fees to play on the course implies the express declaration by the user that he/she is aware of the regulations and that he/she has the aforementioned insurance.

Handicap: At Golf de Andratx a minimum handicap of 28 for men and 36 for women is required, which must be accredited at the time of booking as well as on the course itself.

Green fees: the green fee prices published on the website may be subject to change in the event of a change in the rates in force on the date of issue by the Golf Course. Cancellation of the green fee contracted by the user with less than 3 days' notice will incur a charge of 100% of the cost; in the event of no-show at the course on the scheduled day and time, the user will not be entitled to a refund of any amount. If the agreed services cannot be provided due to force majeure (adverse weather conditions, closure of the course, repairs, etc.), the full amount of the service will be refunded upon accreditation of such circumstances.

4.- Privacy and protection of personal data.

By providing the personal data requested in the contracting process, including the e-mail address, Users/Customers give their permission for these addresses to be processed and also used to send commercial communications for the promotion or advertising of the services and products offered by Golf Camp de Mar SL. Users may at any time contact the e-mail address info [at] golfdeandratx.com to revoke their consent.

Golf Camp de Mar SL declares that it complies with current legislation regarding data protection, in particular Organic Law 15/1999, of 13 December, on the Protection of Personal Data, and Users may exercise their right to access, rectify and cancel the data provided through the means of contact referred to in the previous paragraph. Users may also consult the company's privacy policy at Privacy.

5.- Applicable legislation and conflict resolution:

These General Terms and Conditions shall be governed by Spanish law. In the event of any type of discrepancy or claim between the parties in relation to the fulfilment or content of these General Conditions, the parties submit to the Courts and Tribunals of Palma de Mallorca.
